Shibolei Haleket

(Rabbi Tzidkiyah ben Avraham Anav; 1230-1300; Italy), #211 – "Din Mayim Shelashin Bahem Et Hamatzot Umi Ra'ui Lalush Otan Veseder Lishatan". The Shibolei Haleket takes for granted that the sun travels beneath the earth at night, as per the gentile sages in their dispute with the Jewish sages on Pesachim 94b. אמר רב יהודה אשה לא תלוש אלא במים שלנו פי' שנשאבו מאתמול פי' רבינו שלמה זצ"ל מפני שבימות הגשמים החמה מהלכת בשיפולי הרקיע וכל העולם כולו צונן כנגד גובה של רקיע נמצאו מעיינות של שיפולי הרקיע רותחין. וניסן לענין הילוך החמה מימות הגשמים היא עדיין שאין החמה מתהלכת בגובהו של רקיע עד תקופת תמוז הילכך כיון דמעיינות רותחין חשו למי רוב עיירות שאין להם מי נהרות מי בורות נובעין ובורות שנובעין בשעת שאיבתן הן חמין לפי' צריך שישאבם מערב וילינו כל הלילה כדי שיצונו. וכן יעשה כל ימי הפסח. יש שמדקדקין מדברי ר' שלמה זצ"ל דדוקא למי בורות נובעין ומעיינות נובעין במקום נביעתן איכא למיחש כי האי גוונא אבל נהרות המושכין ובאין רחוק ממקום נביעתן ליכא למיחש מידי. ומיהו אין לפרוץ גדירן של ראשונים ואנו רואין שגם מן הנהרות המושכין עולה עשן מהן בשחרית שכשהחמה מהלכות בלילה תחת הקרקע מחממת את התהום ועשן התהום עולה ומחמם את כל הקרקע תדע שכל מערות ומחילות שתחת הקרקע חמים בלילה יותר ממה שהם חמים ביום בין בימות החמה בין בימות הגשמים. עכ"ל

Rav Yehudah said, "A woman should knead [matzot] only with water that has sat the night" – meaning, water drawn the previous day. Rashi explained that this is because during the rainy season, the sun travels near the lower edge of the sky, and the entire world, facing [as it does] the higher parts of the sky, is cold; while the springs [near] the lower edge of the sky are hot. Nisan is still part of the rainy season with respect to the sun's path, for the sun does not travel through the higher portions of the sky until the spring season. Since the springs are thus hot, [the rabbis made a decree out of] concern regarding the water [available to] most cities – most cities have no river water [which would not be hot like spring water]. [Spring and well water is hot when drawn]; it is therefore necessary to draw their water in the evening and leave it sit all night in order that it cool. ... Some deduce from Rashi's words that the concern about hot water applies only to well water and to spring water at its source, but not to flowing river water far from its underground source. However, one should not breach the tradition of earlier generations, [which was to apply the decree to river water as well]; as we can see with our own eyes, steam rises from flowing rivers in the morning, because when the sun travels beneath the earth at night, it heats the depths, and the steam from the depths rises and heats the whole earth [from below]. Proof: all underground caves and caverns are warmer at night than during the day, during both the sunny and the rainy seasons. [translation by HWMNBN]
