Rabbi Shalom Malka

(?-1895/96; Israel), Vezarach Hashemesh, pp. 13a-13b: Rabbi Malka quotes, as an aside, Beit David’s quotation of the Minchat Kohen’s argument that we follow Rabbeinu Tam’s explanation of the tanna Rabbi Yehuda’s statement even though Rabbeinu Tam’s explanation attributes to Rabbi Yehuda a scientific view we know to be incorrect. He offers no objection to this view, and indeed, it seems that he quotes it only in order to put it on the record either as a possibility, or as the clear truth – possibly to address the potential scientific objection to Rabbeinu Tam’s ruling, which he himself favours.

In any case, you see that almost all of the great [decisors] follow the opinion of Rabbeinu Tam.... Therefore, I am astonished by what Beit David wrote [that Radbaz’s following of Rabbeinu Tam is a minority view] ... for he himself, in section 219, after bringing several proofs that the halacha follows Rabbeinu Tam, writes at the end, “Even though Maharam Alashkar, #96, rejected Rabbeinu Tam’s position at length, it seems that for halachic purposes Rabbeinu Tam’s opinion is favoured, for we find that the Shulchan Aruch was not concerned to quote any opinion other than Rabbeinu Tam’s. It seems his reason was that it was Rabbi [Yehuda Hanasi] who said there in Pesachim [94b] that the gentile sages’ view seems more correct [regarding the path of the sun at night], and we do not follow him against the Jewish sages, for we do not find that the Jewish sages recanted and conceded to the gentile sages; and we also find that they canonized in the ‘Yotzer’ of Shabbat, ‘God who opens daily the doors of the gates of the east and breaches the windows of the sky; brings the sun out of its place, and the moon from its dwelling, etc.,’ which implies clearly that the sun travels above the covering [of the sky] at night [as per the Jewish sages].”

Before we come to the main point, we will quote what [Beit David] wrote afterward: “After [I wrote] this, the book Minchat Kohen came into my possession, and I saw that he wrote that the sun does not travel above the sky, and that Rabbeinu Tam also believed this. It seems to me, however, that Rabbeinu Tam did hold that view, for in Shita Mekubetzet, p. 62, to Ketubot 13a, s.v. ‘Mai ka’amar,’ in the middle [of the piece], he writes, ‘And so did I hear in the name of Rabbeinu Tam – that even though the gentile sages defeated the Jewish sages, this was only a defeat in terms of [persuasiveness of] arguments; but the truth remains as per the Jewish sages, which is reflected in our statement, “and breaches the windows of the sky.”’ Thus it is explicit that Rabbeinu Tam does hold that view.... Minchat Kohen says only that the law of Rabbeinu Tam is correct regardless of whether the sun travels above the sky or below the earth [at night], as expressed in what he writes at the end of page 21c: ‘Even though the truth is that the sun does not enter the thickness of the sky, and there is no second sunset, Rabbi Yehuda’s law is nonetheless correct, and we follow it.... This is the rule that follows from Rabbeinu Tam’s explanation, regardless of whether the sun enters the thickness of the sky or sets below earth, which does not affect this law at all. The proof is that the Maggid Mishneh, notwithstanding that he was greatly knowledgeable in astronomy and knew that the sun does not travel above the covering of the sky at night, and does not enter into its thickness in the evening, nonetheless agreed with the explanation of Rabbeinu Tam, and wrote that it seems correct, and did not find it difficult that this explanation does not agree with the reality. Evidently there is no difficulty in this, for Rabbi Yehuda wrote what he wrote based on his view [that the sun travels above the sky at night, etc.], but his law is correct regardless. This seems to me the true and correct explanation of Rabbi Yehuda.’ He does not mention [the personal opinion of] Rabbeinu Tam at all; merely says that the law of Rabbeinu Tam is true even [though] we know that the truth is that the sun travels beneath the earth, and he brings a proof from the Maggid Mishneh.”
